What happens at the first enquiry?
The first enquiry — whether by telephone or in writing — is an opportunity for you to describe the situation briefly and for us to indicate whether we are well placed to assist. There is no charge for this conversation, and you are under no obligation to proceed. We understand that families often approach legal chambers at a difficult time, and we aim to make the first step straightforward.
How long does estate administration typically take in Malaysia?
The duration depends on the size and nature of the estate, the number of beneficiaries, and whether the estate involves property requiring separate registration steps. A straightforward small estate with modest holdings might be resolved over several months. Estates with immovable property, or those where faraid and testamentary provisions interact, may take longer. We will give you a realistic picture at the outset.
What is faraid, and does it apply to my family?
Faraid refers to the Islamic law of inheritance, which sets out prescribed shares for heirs. In Malaysia, it applies to the estates of Muslims and can intersect with testamentary provisions in ways that require careful navigation. If the deceased was a Muslim, or if the family's circumstances involve both Muslim and non-Muslim members, our advisory service is designed to work through these questions with you in plain language.
What documents will I need to bring?
For an initial consultation, it is helpful to bring the death certificate, any will or testamentary document that exists, and a brief list of assets and liabilities you are aware of. If you do not have all of these, that is not an obstacle — part of what we do is help identify what is missing and how to obtain it. We will guide you through the documentation at each stage.
How are fees structured?
Our fees are set out clearly at the start of an engagement. Estate Inventory and Schedule preparation is from RM 1,940; Faraid and Testamentary Advisory from RM 2,180; and Small Estate Administration from RM 1,620. We explain what is covered within each fee and what, if anything, might give rise to additional costs, so that you can make an informed decision before committing.
Can the family be involved throughout the process?
Yes. We work at a pace that suits the family and provide written documentation at each stage so that family members can follow the progress of the matter. Where advice needs to be considered by family members or religious advisers before a decision is made, we support that process rather than pressing for speed. You are not expected to absorb everything in a single meeting.
