These terms set out the basis on which Testament Chambers provides legal services and on which this website is made available. They apply to all engagements and to use of the website, and should be read alongside our Privacy Policy and Cookie Policy.

1. About Testament Chambers
Testament Chambers is a legal practice based in Kuala Lumpur, Malaysia, providing services in estate administration and inheritance matters. References in these terms to "we", "us", or "the chambers" are references to Testament Chambers.
2. Scope of These Terms
These terms govern:
- the provision of legal services by Testament Chambers to clients;
- access to and use of this website by any visitor;
- initial enquiries made through the contact form or by other means.
A formal engagement letter will be provided at the commencement of any client matter. Where there is any conflict between these terms and an engagement letter, the engagement letter will take precedence in relation to that specific matter.
3. Initial Enquiries
We welcome written and telephone enquiries from those considering our services. An initial enquiry does not create a solicitor-client relationship and does not commit either party to an engagement. We will respond to enquiries in a reasonable time and will, where appropriate, suggest a consultation to discuss the matter further.
No information provided in an initial enquiry will be used for purposes other than responding to that enquiry, in accordance with our Privacy Policy.
4. Commencement of an Engagement
An engagement commences when both parties have agreed to proceed and an engagement letter has been issued and accepted. The engagement letter will set out:
- the scope of the work to be undertaken;
- the applicable fee or the basis on which fees will be calculated;
- any information or documents required from the client;
- an estimate of the likely duration of the engagement, where it can reasonably be given.
5. Fees and Payment
Our fees for the matters described on this website are set out on the relevant service pages. These amounts are stated inclusive of our professional fee and exclusive of any disbursements, government fees, or third-party charges that may arise during the engagement.
Disbursements — such as Land Office fees, application fees payable to Amanah Raya Berhad, or other institutional charges — will be communicated in advance where they are anticipated, and will be billed to the client at cost. We do not add a markup to disbursements.
Payment terms will be set out in the engagement letter. Where payment is required in stages, the schedule will be clearly described. We will not commence substantive work until the first payment has been received, unless otherwise agreed in writing.
6. Scope of Legal Advice
All advice given by Testament Chambers relates to Malaysian law as it stands at the time the advice is given. We do not advise on the laws of other jurisdictions. If a matter involves foreign law, we will say so and may refer you to appropriate advisers in the relevant jurisdiction.
Advice given in connection with a specific matter should not be relied upon in other contexts without seeking fresh advice. The law may change after advice is given, and we accept no responsibility for changes in law that affect the outcome of a matter where those changes occur after our advice has been provided.
Nothing on this website constitutes legal advice. Information published here is for general awareness only and should not be relied upon as a substitute for advice specific to your circumstances.
7. Client Responsibilities
To enable us to carry out our work, clients are asked to:
- provide accurate and complete information about the estate and the circumstances of the matter;
- promptly supply documents and information as reasonably requested;
- notify us without delay of any change in circumstances that may affect the matter;
- respond to correspondence within a reasonable time so as to avoid unnecessary delay.
Where a delay on the client's part materially affects our ability to complete the work, we will communicate this and, where necessary, may need to adjust the estimated timeline or, in exceptional cases, withdraw from the engagement in accordance with our professional obligations.
8. Confidentiality
All information provided to us in connection with an engagement is treated as confidential. We will not disclose client information to third parties except where disclosure is necessary to carry out the engagement, required by law or professional regulation, or made with the client's express consent.
Our confidentiality obligations are not diminished by the conclusion of an engagement and continue to apply after the matter has closed.
9. Limitation of Liability
Our liability to clients in connection with any engagement is limited to direct losses arising from our own negligence or breach of duty. We do not accept liability for indirect or consequential losses, nor for losses arising from reliance on information on this website where that information has not been tailored to the client's circumstances.
Nothing in these terms limits or excludes any liability that cannot lawfully be limited under Malaysian law, including liability for fraud or gross negligence.
10. Termination of an Engagement
A client may withdraw from an engagement at any time by giving written notice. Fees for work completed up to the date of withdrawal will be due and payable.
We may, in limited circumstances, find it necessary to withdraw from an engagement — for example, where there is a conflict of interest, where a client has provided materially misleading information, or where our professional obligations require it. Where we withdraw, we will give reasonable notice and will take steps to minimise disruption to the matter.
11. Website Use
This website is provided for informational purposes. We make reasonable efforts to keep the content accurate and current, but we do not warrant that all information is complete or up to date at any given time.
You may use this website for personal, non-commercial purposes. You may not reproduce, redistribute, or commercially exploit any content from this website without our written permission.
We are not responsible for the content of external websites that may be linked from this site.
12. Governing Law
These terms and any engagement entered into with Testament Chambers are governed by the laws of Malaysia. Any dispute arising from these terms or from an engagement shall be subject to the exclusive jurisdiction of the courts of Malaysia.
13. Changes to These Terms
We may update these terms from time to time. The current version will be available on this page, with the date of last revision noted at the top. Changes to these terms will not affect engagements that have already commenced.
